Legal issues often don't make sense to us layfolk. It seems to be about the narrowest possible interpretation about words in a statute and whether a compelling argument can be made that those words apply to the circumstance under discussion.

 

I'm sure that if you read the contracts issued by Falcon, Titan et. al, you will describe the compensation as being for acting in a video, not for having sex. What is portrayed by the acting might be illegal (think of a movie about bank-robbers or murders), but that doesn't make the acting itself illegal.
