Yes, of course that's true—however you have to ask whether or not the LV police are going to go through that sort of time/energy for a midemeanor. My guess is no. The point of using a Gmail account was going to be for Rusty to create a new escorting identity that would not be immediately associable with his current one.
Glad you clarified, because
2) Create a new email through Gmail. It's not traceable to your computer's IP address.
is erroneous. And I'm almost certain Google has been served a search warrant from LV Metro PD. I'd be willing to bet a $1 to a donut on it. Getting user info from Google with a search warrant is probably a no-brainer for for Vegas or any other large Police Department.

To answer the question..."when do I hire a lawyer"?

As quickly as you can after you realize you are being arrested...period.

The cliché "I want to talk to my lawyer"....is no joke.

You are going to be amazed at all the crap you've already told these nice officers...and it will all be used against you in court.

To reiterate, as soon as you realize the police are questioning and/or arresting you....repeat after me "I WANT TO SPEAK TO MY LAWYER FIRST".

Scream it (and say NOTHING ELSE) as many times as you have to until your lawyer arrives.

If you think you are beating the system on your own....they have already won.

Thanks Rusty for the details. The more we know about stings the more likely we are to recognize them. One last question, when the initial contact was made by phone or whatever, was there a mention or hint of sex, or was only massage discussed? I would expect them to make some mention of sex, since, I assume, massage without more is not illegal.

without more is not illegal.

That's not totally true depends on the state. most states req I license to practice massage. I know florida new york and here in Ga Have so many school hours and a license req. If a officer asks too see your license and you don't produce it you can be taken to jail. I know 6 people were arrested here in 2009 for not escorting not talking about sex. but offering massage or using the term massage without a license. a 1000.00 fine. Also most don't realize you can get in more trouble with massage than escorting. I know a few guys that have dropped the term massage from their escort ads. Here a prostitution arrest is a misdemeanor, massaging without a license is a class E felony I keep my license in a frame near the table at all times. I know one guy the officer walked in and asked to use the bathroom came out showed his badge and asked the guy if he could see his license. He was arrested for massaging without a license. and escorting without a permit. Atlanta also req a permit to escort an arrest for that doesnt req talk of sex and much easier to approve than a prostitution charge. Every single case I know of resulted from backpage and craiglist

Yup... it's very expensive to get caught practicing without a license, or to maintain you have one when you actually do not.

I've thought of this, and I don't remember. I do know he mentioned that he's "from kansas for the weekend and have never been with a man before and figured vegas was the place to try it"

holy cow. why are these details so important. trust me it was all bad enough the first time.

so this is what happened: The officer answered an ad on backpage for an erotic massage. we met in the casino, because it's one of those hotels where you need to show a room key to go up in the elevators. as I played slots, the officer (who was very convincing as a guy from Kansas who was looking for a first time with another man) listed a few things we might want to do after his massage. I said ok. asked "is this all included in the price of the massage?" I said yes. We went up to the room. he handed me some dough. he asked me to wait while he took a shower. I sat down to wait. the other cops came in and arrested me. to my mind, this is the classic definition of a sting.

They got 5 of us that night, two of whom were girls who had previously been arrested at the same place; they were arrested for trespassing.

I was wearing black jeans, a gap shirt, and tassel loafers. no socks, no underwear.

any more questions?

Sorry, but I keep wondering how wise it is to be giving so much detail in a public forum?

The cop asked the masseur "are all these things included in the price of the massage?" and the masseur said yes. If the masseur had said "Sir, you are paying for the massage. Anything above and beyond that is free and just something we might get into as two consenting adults." Would this have kept him from being arrested?

If they masseur is in a state that req a license to massage they can still be arrested. someone told me once if you every end up in the room with LE you are going to be charged with something.

She said if you ever suspect it then order room service a nice expensive meal and wine at the states expense because soon you going to be dinning on peanut butter and jelly sandwiches lol

Keep in mind that if the cops are there, they are most likely going to arrest first and ask questions later. It's ridiculous that not having a something relatively harmless and benign like not having a massage license is a felony, compared to most traffic violations (which can actually put someone in real danger and are a misdemeanor). But that's a reflection of government's attitude towards sex and industry. It's a game of intimidation and pestering—they know that they have the resources and time to drive most people out of business, or prevent them from ever starting. This is why adult bookstores often open up outside city limits, because the legal hoops and red tape are often too annoying for the average business person to deal with.

I personally don't put sensual and erotic massage in the same boat with therapeutic massage. I dont think a person offering strictly erotic or sensual massage should have to go out and spend the 10.000 on massage school and licenses that I spent as long as they stick with just that. However I do agree with req licenses if the person is offering therapeutic services such as deep tissue, sports and other therapeutic services. Because those types of bodywork can result in a injury in performed incorrectly

I've always wondered what was up with that. How come you never hear about anyone being arrested from Rentboy or sites like that?

There has to be a reason. I've often wondered if I've ever come close to being part of a bust—but then I tend to be hyper-suspicious and will cancel at the slightest provocation.

When a person gets caught for escorting or doing massage for whatever reason, does the court look into their tax records to see if they actually declare the money received? Just wondering if this adds to their problems with tax evasion.

Separate issues, I should think. Stings such as these are ran by the local vice squad or what have you, tax evasion is either a state or federal issue. I do not think that these agencies cooperate. I suspect the motivation for these stings is either to make a problem go away or to sway some local vote (by appearing "tough on crime"), but I suspect the tax authorities are clever enough to realize that going after most escorts or masseurs is like trying to get blood out of a turnip.

Craigslist and backpage are used by "middle America" and soccer moms to sell and buy stuff. They don't like to see sexual listings on the same site that they are using. They complain to the city council, city council complains to the police and they go to work.

I think that's about it. Thank god rentboy put the kibosh on selling those hand-crafted birdhouses.

What happen to me was more of a conflict with a bad neighbor than anything. In my former town I was there almost 7 years. Had a problem with a neighbor i reported the problem. . since I had a massage license I wasn't arrested but was charged with a bunch of nit picky code violation like not iding a client. IMO it was just to get me to move away. easier to get rid of me than to get rid of bad neighbor. Unfortunately escorting and massage or any form of adult entertainment is a job that requires one to walk with his or her head down. someone could be robbed or killed in the parking lot and anyone could call the police but you...

Neighbors who don't like something you are doing usually cause more problems than doormen or security personnel. They don't want something "like that" going on next to them in their building.

In my case she was blasting music all the time you could hear it thumping through the wall at 2am. I was suffering from severe sleep issues. then she had a visit from a relative he brought his dog and she made that dog sleep in his car allnight. I called the cops on her and reported her to the leasing office. I didnt know at the time she had taken a job in the office. I think they googled my number then pushed for something to happen. lesson learned never use same phone number for personal life as business. never register web site in real name use a proxy. use fake name for business

I'd say you're hyper-aware not hypersensitive. But yes, both client and escort should be willing to walk away without a moment's notice if something is amiss. I've only done it once, but the guy who showed up wasn't the guy in the photos. That was more than enough. FYI, I look out the window/peephole and if it's wrong - Nobody's home.

Tax authorities are more focused on size of deposits, sources of deposits (cash/money orders) and frequency of deposits along with lifestyle choices like rent/mortgage, car ownership/loan/lease, and value of personal possessions. They tend to crawl up your butt via paper trail. It's easier to make a case versus one bust for solicitation.

Whatever I am, it's hyper-not-wanting-to-get-arrested-again. I got busted by some prick for a driver's license expiration and they hauled me in. Not fun and a great waste of an afternoon.
