Frankly, I don't believe a judge (even in TEXAS) would allow a sting operation based upon an ANONYMOUS letter. There has to be justifiable cause before the FBI does something like that, otherwise, law enforcement could do anything they wanted by saying: "Judge, you see, we have this anonymous letter here, can we go set up (you fill in the blank)?"

 

But then again, if you are attractive, have a great body and a huge cock, it makes the story easier to swallow, doesn't it?

A warrant could only have been obtained if law enforcement developed independent evidence that a crime had been committed. So there is a little more going on here than the board has been told.

It's comforting to know that SOMEONE is paying attention to what I'm saying.

I have nothing against Kristian. I've never met the guy. I wasn't the one who first related the vague events of la nuit terrible. The events were carried with much fanfare and I commented on the odd course of events. The story made no sense in the beginning and now that Kristian (I assume it's Kristian who's posting) has given more details, it makes even LESS sense.

 

What makes no sense is the ANONYMOUS LETTER. Everyone here knows the FBI will not and CANNOT move on an anonymous letter - as I've pointed out, if they could, EVERYONE could be targeted: all the police would have to do is produce an anonymous letter. Contrary to those of you on the radical left, America has not descended into facism.

 

Is it possible that the FBI did arrest Kristian? Sure. However, based upon the story he's related, it's highly unlikely that's what really happened.

 

One thing that's been missing in all of this is that the Free Kristian Defense Fund paid his bills for two months. So, it's now confirmed that a number of his johns did send him money without knowing the facts (which are STILL unknown).

For the FBI, local cops or whatever police agency to conduct a "sting" (as you phrase it) against a person and pry for more information, no judicial oversight or search warrant is required and is something that is typically done.

 

Wiretaps and search warrants however, do require judicial approval and for a search warrant, such approval can be had with only "probable cause"--a much lesser amount of evidence than is required to convict. And that "probable cause" is only that a crime has or is being committed by the person and on the premises to be searched--so even though the agency is investigating child porn violations, if they can show PC for prostitution, then they can get the SW for prostitution and search for everything they want to anyway.

 

This system is heavy on abuse, similar to your posts.

As I was typing, I kept saying "it's not justifiable cause" - I couldn't come up with the word "probable".

 

Now that we've gotten THAT bit of minutae out of the way, let me address the flaw in your argument.

 

If the FBI doesn't have probably cause, ANY evidence they have against a person will be THROWN OUT by a judge.

 

So, to use Kristian's example, law enforcement will go into court and say "Your honor, we got this anonymous letter...." and before they can continue he'll/she'll cut him/her off and ask what other cause they had to set this person up and they'll reply: "Well, nothing" and the judge will then dismiss all charges. Remember, if you're pulled over for speeding, if they look in your trunk (without your permission) and find 2 tons of cocaine, that evidence will be thrown out for lack of PROBABLE cause. According to Kristian, he was set up by an anonymous letter. An anonymous letter is NOT probable cause.

 

So, we're back to where we started: a story that has more holes than Donnie's filthy underwear.

Your language is very imprecise and is therefore inaccurate. The FBI can certainly "move on" an anonymous letter if "move on" means nothing more than "initiate an investigation." What neither the FBI nor any other law enforcement agency can do, however, is enter a private home, search it, and seize the occupant's belongings simply on the basis of an accusation from an anonymous source. K's account of what happened indicates that there was an investigation of some sort and that the investigation produced evidence that was used as the basis for a search warrant and an arrest. What his account does not explain is what that evidence was. I doubt anyone would make an arrest based on nothing more than a remark that it might be possible to have sex with an underage prostitute if one goes to Mexico. Something else must have occurred but we do not know what.

 

If one is really interested I suppose one could ask him, but does it really matter? The idea of a prostitute getting arrested seems to me about as newsworthy as "Violence in the Mideast" or "Corporation Accused of Inflating Earnings."

He says that the authorities investigated the letter, which is not the same thing at all as acting on the basis of just a letter. It's also clear that Kristian made some mistakes in talking to the undercover agent.

 

Few escorts have been willing to post such personsal information on this site. Frankly, only his lawyer might have given an explanation that covered all the bases.
