No, that's not right. An oral (you will pardon the expression) contract is just as binding as a written one. But the problem is establishing what was said (he said/she said), which you don't have with a written contract (but *interpreting* what's in a written contract can also be very messy). Broken wedding plans can lead to legal disputes, too - "breach of contract" or "breach of promise". As for "there is no obligation for the escort to do anything" that's not so. The original author doesn't have to prove that the money was paid for sex (everyone will assume that anyway, but that's irrelevant). The "escort" was paid $400 for *escorting*, which he he is then obligated to do, and which he didn't do. If AH had shown up and spent 2 hours with the client doing absolutely nothing, he might have a leg to stand on, though even then the case could be made that "escorting" in that fashion is not within the normal range of escorting. But for not showing up at all he is in default, as long as it can be established that he did indeed pick up the money. On the other hand, a contract (written or oral, witnessed, notarized or anything else) to perform an illegal act is not valid. So let's hope the client wasn't too specific in any emails, especially if AH kept them.

HooBoy, thanks for making that clear, on behalf of those of us that didn't log on during the couple of hours those postings were up. And it seems to be 4 postings that are gone (13-16), not just 2.

Because Anthony’s reviews are going up tonight, I want you to know what has transpired from my end.

 

“Loverboy” wrote me with the allegations that he has documented here. He asked me to help him get his money back.

 

We do not do that here, however, I did tell him I would investigate his allegations.

 

First stop: Anthony Holloway. His response will be posted along with Loverboy’s review, however Anthony says Loverboy is a liar.

 

I emailed Anthony’s response to Loverboy and Loverboy basically said Anthony was a liar and he said I should call Western Union. He gave me a phone number and a confirmation number. I called the Western Union phone number that Loverboy directed me to and I got confirmation that Loverboy sent $400 to someone (no name mentioned) and that it was picked up by someone (again no name mentioned.)

 

All I had thus far was a he said/he said scenario and the fact that Loverboy sent $400 via Western Union. He could have sent it to himself for all I know, I told him he was STUPID for sending someone he did not know $400 via Western Union and I asked him to take his complaint to the MESSAGE CENTER, which he did.

 

Granted, Loverboy knew Anthony’s real name, but that proves nothing.

 

Then, Loverboy told me he was going to get a FAX of the perp’s signature from Western Union today (Monday.) I asked Loverboy to FAX it to me as well and gave him my FAX number. As of 11pm Eastern I have received nothing.

 

Folks, I am spending a lot of time doing due diligence to try and figure out if the allegations are true. Meantime, there are posters here who are actually after blood, threatening Anthony with dismemberment. Then other’s jump in and want to cut Daddy-In-Training’s head off for moderating.

 

Earlier in the week, I posted a warning on Anthony’s review page to not send money to anyone you do not know. For now, I have NO PROOF that Anthony ripped anyone off other than what was alleged and he denies it. So do not send him money in advance! Do not pay him in advance!

 

But please do not allow people to use this website to promote mob-lynching hysteria.

Well, he or you removed my post and I didn't threaten violence against anyone. This is the first message board I've encountered that is ran by such insecure people who feel they have to make up excuses to delete posts from those who disagree with them.

Sorry, but it's not irrelevant. The author didn't pick AH's name out of the White Pages at random and send him $400 in the hope that he would come and spend time with him. He contacted AH because AH advertises on a website for gay prostitutes. Under the circumstances, no court is going to enforce the "contract."

The best thing that anyone can do is to heed the many warnings about Mr. Holloway's behavior by not only not paying him in advance but by also NOT hiring him.

The point here is this: there are more creative ways to make sure Anthony gets what he deserves. Threatening physical violence is stupid beyond reason.

 

One thing some of you may not realize is that Hooboy can get in a lot of trouble if he does not take down posts that contain such threats, whether they are real or just blowing off steam.

 

And isn't it interesting that AH is once again using the "bad check" scenario that he used as an explanation before....

Insecure? ROTFL, If I was insecure, I'd let all messages through no matter how vile. Excuses? Here's mine: "I'm Daddy, and I get one extra vote".

 

I don't exercise it often, but don't mistake that for not being able to. I tend to be extremely tolerant, but lately I've been easier to provoke. Maybe it's the phase of the moon.

Mine was one of the deleted posts....I assume because I mentioned "Lorena Bobbit"being his next client. I suppose that it could be viewed as threatening to some people. I feel that the situation that occured here has angered many of us and that somehow we want to make sure it doesn't happen again and at the same time, try to get Loverboy his $400 back. From everything that HooBoy and others have said, it does indeed appear that the little fucker did "steal" $400. Following is his reply to HooBoy, which appears in today's reviews:

As you can all see, he contradicts himself in the post. First he doesn't know the guy then he tries to cash his check. etc. etc.

I don't know what the solution is but hopefully, legitimately, he will be forced to return the money....in my opinion, the only way for Loverboy to get satisfaction. I would like to think that Holloway has been reading this thread and knows what people really think of him. If, as mentioned in above posts, his "advertisers" can be made aware of his modis operendi, they will refuse him to advertise and his business will go down the tubes. He may indeed end up keeping the $400 but will probably have to find another line of work. He says he is using this job as a "stepping stone".....to what? The Tony Soprano gang?

This message board will never have true credibility as long as you feel it is OK to systematically delete posts that for whatever reason you personally don't like. A real message board is suppose to be a forum where everyone can express their views -- regardless of whether the moderator disagrees with them, dislikes them, or is even insulted by them.

 

But it is YOUR board for which you have the right to do as you wish. And although you didn't feel that a prior post of mine "was nice," I stand behind my statements. And, ironically, you have only reinforced those views since then.

 

I for one (and this should make you very happy) will be making this my last post on this board. With you moderating it, it's just not a credible message board.

pickwick, you misinterpreted my comment, and you apparently didn't read it to the end. "irrelevant" refers to the fact that *everyone will assume* it was for sex, not that it was for sex. That's an assumption, not a fact. There are lots of things that escorts, both gay and straight, are hired to do that don't involve sex. But AH didn't do any of them, sex or otherwise.

So if the client can make a credible claim that the escort was hired for a purpose that is not illegal, and if there is no rebutting email trail, he has a case. On the other hand, a contract to perform an illegal act is not valid, which is what you seem to be referring to, and which is also what I said near the end of my earlier posting.

(And anyway what we are talking about here is only hypothetical. It's not likely that the original author will take this to court, for a lot of reasons, not the least of which is opening himself to a charge of soliciting, which has already been mentioned by others.)

I just don't understand what people are thinking when they hire him. No offense, BUT, and that's a big but. I believe this site is a godsend for both clients as well as escorts and I usually find that what is said here is more often than not, the truth. Anthony Halloway has screwed over more people in this business than he has actualy screwed. Or so it seems. I however, have never met him. But i do take great caution when anything involving his name is concerned. I suggest the same to the rest of you from now on. I am very sorry for what has happened and the reflection that is put upon all escorts for his actions. I don't have his body or cock, but I'd be more than happy to take care of you Papi ;-)~ LOL Wish you all well.
